We appreciate that students have many questions about the upcoming semester and this change, and we understand that students are eager to make their plans for the spring semester, including travel arrangements and internship opportunities. September 30, 2020: ISSS Statement regarding removal of Duration of Status (D/S)
ISSS is aware of the proposed rule released by the Department of Homeland Security (DHS) regarding the removal of the Duration of Status (D/S) for F-1 and J-1 visa holders. We understand concerns regarding this proposed rule.
Currently, this is only a proposed rule to eliminate duration of status and has not been implemented nor taken effect at this time. This proposed rule is still in its comment period, which allows comments from the public, institutions (colleges/universities), and employers to submit their concerns with this new rule for 30 days after release. The ISSS staff is currently reviewing the proposed rule and we will be adding our own comments to the Department of Homeland Security (DHS) before the comment period ends on October 26. After the comment period, DHS will review the comments and then make changes to the final rule to be published. This process takes months to complete and this also means that the proposed rule never looks the same as the final rule.
When the final rule is published months from now, ISSS will send out information and update all our F-1 and J-1 population regarding any new processes that are implemented. At this time, there are no changes and F-1 and J-1 visa holders do not have to do anything related to the rules proposed in this legislation.
